Terms & Conditions

  1. Purpose

    These Terms & Conditions govern the subscription and use of the Callkom SaaS solution (“the Service”).
    They apply to any professional client within the European Union.

  2. Service Description

    Callkom is a SaaS solution providing intelligent voice and text agents, accessible via a web interface.
    The subscription grants access to features according to the chosen plan.

  3. Subscription & Commitment

    Subscriptions are monthly, with a minimum commitment of 1 month, tacitly renewed.
    Termination must be notified in writing no later than 7 days before renewal.

  4. Pricing & Payment

    Prices are in euros (excl. VAT), subject to applicable VAT.
    Payment is made by credit card or SEPA direct debit via Stripe.
    In case of non-payment, Callkom may suspend access to the Service.

  5. Client’s Obligations

    The Client shall:
    Provide accurate information during registration.
    Not misuse the Service for fraudulent or unlawful purposes.
    Comply with applicable law (GDPR, telecommunications).

  6. Callkom’s Obligations

    Callkom undertakes to:
    Ensure availability of the Service, except in case of force majeure or planned maintenance.
    Protect Client data with appropriate technical and organizational measures.
    Inform the Client of any substantial changes to the Service.

  7. Intellectual Property

    The Service (software, interface, documentation) is protected by copyright.
    The Client is granted a non-exclusive right of use, limited to the subscription term.

  8. Personal Data (GDPR)

    Callkom acts as a data processor for Client data processed via the Service.
    A DPA (Annex below) details Callkom’s commitments.
    Data is hosted within the European Union.

  9. AI Clause

    The Callkom Service is based on artificial intelligence (AI) technologies enabling automated voice and text dialogues.
    The Client acknowledges that AI-generated responses may contain errors or inaccuracies and undertakes to verify their relevance.
    Callkom shall not be held liable for decisions made solely on the basis of AI responses.

  10. Liability & Limitations

    Callkom is not liable for interruptions caused by the Internet or third-party providers (telecom operators, Stripe).
    Callkom’s liability is limited to the total fees paid by the Client during the last 12 months.

  11. Termination

    The Client may terminate according to Article 3.
    Callkom may terminate in case of serious breach of these T&Cs.

  12. Governing Law

    These T&Cs are governed by French law. Disputes shall be submitted to the courts of Callkom’s registered office jurisdiction.

Annex — Data Processing Agreement (DPA)

Purpose: processing of voice, text, and contact data under the Callkom Service. Duration: for the term of the contract. Nature: calls, transcriptions, recordings, routing, analytics. Types of data: name, phone, email, voice and text data. Data subjects: prospects, end-customers of the Client.

Callkom’s obligations:
Process only on Client’s instructions.
Maintain confidentiality.
Implement security measures (encryption, restricted access).
Assist with GDPR rights requests.
Notify any data breaches.

Authorized subprocessors: cloud host, Stripe (payments), telecom providers.
Location of processing: European Union (or adequate countries).
End of contract: deletion or return of data.
